Digital Millennium Copyright Act (“DMCA”) Notification Guidelines

At hope-inns.com, we take intellectual property rights very seriously. In compliance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we have established this page to guide copyright owners and authorized agents on how to notify us of any alleged copyright infringements appearing on our website.

We understand the importance of protecting original work and intellectual property. If you are the copyright holder of any material that is mentioned or linked to from our site and believe that your rights have been infringed, we invite you to file a formal DMCA takedown notice. We will respond promptly and take appropriate action upon receiving a properly formatted request.

Submitting a DMCA Takedown Notice

If you decide to request removal of content by submitting a notice of infringement, please remember that you are initiating a legal process. Do not make false statements. Misuse of this process may result in your account being suspended or other legal consequences.

You can report suspected copyright infringement to OnlyFans by filling out the form. This form will help you accurately identify your content and expedite the removal process.

To ensure that your notice meets the standards set forth in the DMCA, your written notification must include the following elements:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. A clear description of the copyrighted work or other intellectual property that you claim has been infringed;
  3. An exact identification of the location (e.g., URL) of the material that you claim is infringing or the subject of infringing activity and which is to be removed or access to which is to be disabled;
  4. Sufficient contact information by which we can reach you, including your full name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in your notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Failure to provide all of the above information may result in a delay in processing or rejection of your request.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA notice may not be valid.

Please note that if you knowingly materially misrepresent that any material or activity on OnlyFans infringes your copyright, you may be subject to liability for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

The name of the copyright owner will be published on OnlyFans in place of the blocked content. This will become part of the publicly available information about your DMCA notice, along with a description of the works that are allegedly infringed. All information provided in the DMCA notice, in the DMCA notice itself (including your personal information), or both, may be shared with the user who uploaded the allegedly infringing content. By submitting a DMCA notice, you consent to having your information disclosed in this manner.

Counter-Notification Policy

If you believe that your material was removed or disabled due to a mistake or misidentification, you may submit a counter-notification. Such a notification must comply with the requirements of the DMCA and include:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court in your area (or if outside the United States, to the appropriate jurisdiction), and that you will accept service of process from the person who submitted the original DMCA notice or an agent thereof;
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If they do not file a lawsuit within 10 business days, we may restore the material at our discretion.

Please note that when you forward your counter-notice, your personal information will be included in your counter-notice. By submitting a counter-notice, you consent to this disclosure. We will not forward the counter-notice to anyone other than the original complainant, law enforcement, or individuals assisting us in enforcing and defending our rights.

Please note that if you knowingly materially misrepresent that material or activity on OnlyFans was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

Repeat Infringers

In accordance with Section 512(i)(1)(A) of the DMCA, hope-inns.com has a policy to terminate, in appropriate circumstances, users or contributors who are repeat infringers of intellectual property rights.

We reserve the right to take additional actions against any user or party who has been found to violate copyrights more than once. This includes, but is not limited to, restricting access to our platform, blocking IP addresses, or removing any related content without further notice.

If you believe a user is a repeat infringer, please provide documented evidence of multiple DMCA violations when submitting your notice.
